    You have all seen, and maybe some have unintentionally purchased, a knockoff or a fake. There is a good rule of thumb when buying new or vintage design classics: if there is no mention or markings of the manufacturer, the piece was probably not made by the original or licensed manufacturer. In other words — it's a knock-off.

  • Fakes in the marketplace: Emeco settles with IKEA over copyright question

    American furniture brand Emeco has accepted an out-of-court settlement from IKEA after accusing the Swedish furniture giant of copying its Emeco 20-06 stacking aluminum chair, designed by British architect Norman Foster. The agreement makes clear that Emeco owns the intellectual property rights to the 20-06 chair, which was designed by Foster in 2006.

    Emeco had claimed that IKEA's stacking Melltorp dining chair was "very, very similar" to its own product. IKEA disagreed with the claim.

    The settlement is the latest victory for Emeco, which has resorted to legal action to protect its designs on several occasions in the past.

    In 2013 it reached a settlement with the US furniture giant Restoration Hardware, which it had accused of copying its iconic aluminum Navy Chair. Restoration Hardware agreed to cease selling the product.

    Emeco's CEO Gregg Buchbinder expressed his frustration at firms that copied their products, "It's something that, as a manufacturer that puts a lot of time and effort into the development and research and everything else, is a very hard thing to swallow."

    In a related story Airbnb replaced a set of eight aluminum chairs at its new San Francisco headquarters after Emeco pointed out that they were fake Navy Chairs.

    Emeco’s experience with fighting replicas and reproductions of its designs is a small part of the ongoing problem of fakes in the marketplace.

    Recently the delivery of 100 replicas of Danish designer Hans J. Wegner’s Round Chair were seized and destroyed by Norwegian customs.

    In the UK, manufacturing and selling copies of mass-produced designs won't be illegal until after 2020, when a new copyright protection law will be introduced to give industrially manufactured items the same protection as works of art, books or music.

    The change to the law followed a wide debate on copyright for furniture designs after the British prime minister's wife purchased a reproduction of the Castiglioni brothers' iconic 1962 Arco Floor Lamp in 2011.

  • Good news - after 13 years in the Italian courts, protection against copyright infringement.

    Finally some good news on the question of illegal copies and knockoffs of Italian furniture designs that have inherent creative and artistic value. The manufacture and marketing of products which "slavishly imitate the stylistic and aesthetic features of iconic pieces of Italian design" has been the subject of recent Italian courts decisions. This new ruling is aimed at the protection of original Italian industrial design through the enforcement of copyright protection.

    This good news was hailed by Gianluca Armento, Cassina’s Brand Director, who says, “…the Italian Industrial Property Code states that the law can punish all those who produce or commercialize imitations of products protected by copyright as counterfeiters…This important result is thanks to the coordinated action between Cassina, other companies involved, and the various organizations and institutions who represent the furniture sector. This is an important step for our country towards the recognition of the rights of companies who invest in and produce works of authentic design on a daily basis.”

    In 2006, Flos, an Italian manufacturer of designer lighting, brought proceedings against the furniture producer and retailer Semeraro before the Court of Milan. They argued that Semeraro had infringed its copyright on the Arco Lamp, a masterpiece of post-war Italian design created by the Castiglioni brothers in the 1960s. Semeraro denied any infringement by arguing that the Arco Lamp was not eligible for copyright protection because it lacked “inherent artistic value” under the Copyright Law. The Court ruled that Semeraro infringed on Flos’ design rights, ordered the seizure of the imported lamps and prevented Semeraro from continuing to market them.

    The Court of Milan also recently granted copyright protection to the well-known Panton Chair designed by Verner Panton and produced by Vitra. According to the Court, the exposure of this work in famous exhibitions and museums was considered evidence of its artistic value, making this item eligible to copyright protection.

    There is still a long way to go in this battle against copyright infringement and the production of “Franken-Chairs” and everyone is strongly urged to please be sure that what you are buying is original, authentic and that the designer is receiving credit for their creative works.
